It depend of the state, Signal providers, Hedge Funds, can't be enforced but Software Companies or any developer of intellectual property can be is his product fail to perform or cause a loss to you. Of course if you hired an EA developer to program a system based on
your own rules, you can't sue him for non performance unless the system don't follow your rules.
Unfortunately most EA Sellers or developers of Black Boxes elect to commercialize their systems from states where this law can't be enforced or from outside of our country.
